Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the HeadsUpDaddy application (“HeadsUpDaddy”, “the app”), published by WakeSys sarl, Luxembourg (“we”, “us”). By downloading, installing, or using HeadsUpDaddy, you agree to these Terms. If you do not agree, do not use the app.

Medical disclaimer: HeadsUpDaddy is not medical advice. It is not a contraceptive and must never be used as one. It is not a fertility treatment. It estimates a calendar from dates you log; it does not diagnose, treat, or prevent anything. For medical guidance, consult a qualified clinician.

1. Age & content rating

HeadsUpDaddy is rated 17+ on the App Store, driven by its opt-in Unfiltered tone tier (frequent or intense crude humour). You must be at least 17, or the age of majority in your jurisdiction if higher, to use HeadsUpDaddy, and you confirm that you meet this requirement.

2. License

We grant you a free, limited, non-exclusive, non-transferable, revocable license to download and use HeadsUpDaddy on Apple devices you own or control, for personal use, in accordance with these Terms and the Apple App Store Terms of Service. We retain all rights, title, and interest in the app.

3. Acceptable use

You agree not to: (a) use HeadsUpDaddy for any unlawful purpose, including surveillance of a person without an appropriate basis to do so under applicable law; (b) reverse-engineer, decompile, or disassemble the app except to the extent expressly permitted by applicable law; (c) resell, sublicense, or redistribute the app; or (d) rely on the app's predictions for any medical, contraceptive, or fertility-treatment purpose.

4. Your responsibility for tracking another person

You are solely responsible for how you use HeadsUpDaddy with respect to another person — including obtaining any consent required by law and being honest with her about the app, as described on our Yes, She Knows page. HeadsUpDaddy requires an in-app acknowledgement before a profile becomes active, but that acknowledgement reflects what you told the app, not something we can independently verify. We are not responsible for how you use the app in your own relationships.

5. Not medical advice, not contraception

HeadsUpDaddy predicts a menstrual cycle from dates you log using statistical averages. It is not medical advice, not a contraceptive, and not a fertility treatment, and it is not intended to diagnose, treat, cure, or prevent any condition, or to be used for family planning of any kind, including as a method of avoiding or achieving pregnancy. Predictions can be wrong, especially with limited or irregular history — the app will tell you when it is, and you should never treat a prediction as certain.

6. No warranty

HeadsUpDaddy is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that predictions will be accurate, that notifications will always arrive on time (iOS limits background execution and pending notifications, which the app works around but cannot fully guarantee), or that the app will be uninterrupted or error-free.

7. Limitation of liability

To the maximum extent permitted by law, in no event will WakeSys sarl be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) HeadsUpDaddy, including any loss of data upon uninstalling the app, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability relating to the app will not exceed fifty US dollars (USD $50). Because the app is provided free of charge, this allocation of risk is a basis of the bargain.

8. Data loss on uninstall

HeadsUpDaddy has no server. If you uninstall the app without first exporting an encrypted backup, all data it held — every profile, every logged date — is deleted irrecoverably. We cannot restore it, because we never had it.

9. Third-party services

HeadsUpDaddy relies on Apple operating-system features (such as UserNotifications, WidgetKit, App Intents, and LocalAuthentication). Your use of those features is subject to Apple's terms. We are not responsible for changes Apple makes to iOS that affect the app.

10. Apple App Store terms

HeadsUpDaddy is distributed through the Apple App Store. The Apple Licensed Application End User License Agreement (Standard EULA) also applies to your use of the app. Apple is not a party to these Terms and is not responsible for the app or its content; however, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Any claim relating to the app should be directed to us, not Apple.

11. Changes to these Terms

We may update these Terms from time to time. The “Effective date” above shows the latest version, posted at this URL. Continued use of the app after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the Grand Duchy of Luxembourg, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live. The courts of Luxembourg will have jurisdiction, subject to those mandatory rights.
